1. According to the laws of the People’s Republic of China on education, the People’s Republic of China’s regulations on higher education, the Common University Student Management rules, and other regulations, the regulations formulated herein are instituted for the purpose of maintaining normal education work, supporting students’ physical and spiritual health, promoting students’ moral, intellectual, and aesthetic development, and teaching students the skills necessary to become active, constructive contributors to society and social well-being.
2. These provisions shall apply to fulltime undergraduate students enrolled at this university, and shall be used as a reference and guide for students of other categories.
3. The university will administer disciplinary action to students in accordance with principles considering students’ educative and disciplinary circumstances, with the recognition that students’ rights have priority. Punitive actions against students for inappropriate behavior shall be just, supported by adequate evidence or proof, with clear references, in accordance with stipulated definitions, and with proper measures and forms of punishment.
4. Students who break laws, regulations, or conventions will be issued warnings of varying degrees of severity, retained in school but placed on surveillance, or expelled, depending on the seriousness of the offense or offenses committed. Students whose violations are not serious enough to warrant punitive measures will still be reprimanded through notice and admonished by authorities of their particular school of study to correct their mistakes.
5. Offending students who admit their mistakes in a timely manner, willingly submit to inspections, and comply with recommendations or requirements for adjustment and reform, will be handled with less severity, when appropriate.
6. More serious punitive measures shall be administered in circumstances in which any of the following occur:
a. Refusal to admit offenses or violations, or unwillingness to comply with any punitive measures demanded
b. Retaliatory behavior or threats of such behavior against prosecuting officials, witnesses, or inspectors for administered punishments
c. Disciplinary actions against the student for previous violations not related to the present offense, or for the violation of more than two regulations
7. Students punished with disciplinary action shall also be subject to the following forfeitures:
a. Opportunities for scholarships or other titles of honor shall no longer be given
b. Opportunities for study grants shall no longer be offered
8. Students who violate constitutional laws, exhibit behavior contravening the four fundamental principles, disturb the stability or unity of society, or seriously disrupt the social order shall be disenrolled from the university. Students who organize illegal groups or who instigate large gatherings, parades, demonstrations, or similar occurrences, shall also be disenrolled from the university. Those who partake in large gatherings, parades, demonstrations, or events of a similar nature shall be reprimanded and warned according to the seriousness of the condition.
9. Students who violate national laws or commit criminal offenses, or who violate the laws of public security management according to the People’s Republic ofChinashall be disenrolled from the university. Students who engage in other illicit practices or behaviors which contravene the laws of public security shall be subject to punitive measures more serious than warning according to the seriousness of the practices or behavior.
10. Students who damage national or public property, or the property of other persons, shall be accordingly reprimanded and ordered to provide appropriate compensations for the damage.
11. Students who steal or otherwise illicitly appropriate national or public property or information, or the property or information of other persons, such as by stealing, duplicating, or faking others’ identification cards, shall be subject to the following punitive measures according to the seriousness of the action and their attitude towards it:
a. Minimally, a warning for stealing less than 1000 RMB, and disenrollment from the university for stealing more than 1000 RMB
b. Minimally, a warning for stealing books or other forms of information
c. Minimally, serious warning for stealing, duplicating, or faking others’ cards
d. Minimally, retention in school but placed under strict surveillance for engaging in acts of stealing or cheating several times
12. Students who plan, organize or partake in fighting, but whose activities are not serious enough to be deemed criminal offenses, shall be punished according to the following, in addition to being required to compensate victims for medical care expenses, nutrition fees, and loss of property:
a. Students who beat or otherwise attack others shall be warned seriously according to the severity of the condition. Those who beat or attack others with weapons shall be issued a formal record of offense, and those who beat or attack others seriously shall bekept in school but placed under strict surveillance.
b. Those who plan and organize the beating of others with less seriousness of intention shall be punished with at least a warning, and if the condition is serious, shall be punished with at least a formal record of their offense.
c. Those who deliberately provide weapons for beating others, but with less seriousness of intention, shall be reprimanded with a formal record of the offense, and if the intentions are serious will be placed under strict surveillance while remaining in school.
13. Those who leave school unauthorized, or commit acts of truancy, shall be punished as follows according to the severity of the condition:
a. Those who leave school unauthorized, do not come back to school in time, or fail to partake continuously in scheduled courses, shall be punished with a warning for less than 5 days, shall be reprimanded with a formal record of offense if more than 5 days, and shall be placed under strict surveillance while remaining in school if between 10 and 14 days.
b. Those committing acts of truancy shall be punished as follows:
1) Up to 30 class hours within one term, shall be punished with a warning.
2) Up to 50 class hours within one term, shall be punished with a formal record of offense.
3) Up to 60 class hours within one term, shall be punished with strict surveillance while remaining in school.
14. Cheating on examinations shall be dealt with according to the examination discipline and associated regulations pertaining to cheating on exams.
15. Students who, in the process of writing scientific or other academic papers, plagiarize their results from the research or writing of others, or who appropriate others for the writing of their own with the intention of taking credit for the writing, shall be punished, minimally, with a warning, and may possibly be disenrolled from the university, depending on the circumstances and severity of the offense.
16. Students who violate the school’s management regulations, disturb or disrupt processes of formal education and life at the university, or violate the rights of other individuals or organizations, shall, if the condition does not constitute criminal offense or activity, nonetheless be subject to the following punitive measures, in accordance with the severity of the condition:
a. Those who violate school regulations, adversely affect the order of school education, the orderly management of public places, or the general routines of day to day life, or who violate the rights of other people or organizations, shall, when the condition is serious, be subject to the punitive measure of disenrollment from school.
b. Those who disturb the normal work order of the school’s procedures of education, resist or refuse to cooperate with school personnel’s management routines, insult or attack school personnel, shall be punished, minimally, with a warning in accordance with the nature of the condition.
c. Students exhibiting intemperate behavior shall be punished with a warning. Those who consume alcoholic beverages and disrupt social order shall be reprimanded with, minimally, a formal record of their behavior, in accordance with the condition.
d. Those who smoke in public places, including classrooms, libraries, reading rooms, dormitories, canteens, and general campus settings, shall be punished with warning.
e. Those who raise or harbor pets or other animals in public places, or in dormitories and classrooms, and thereby affect the normal work order of the school, and who do not correct their behavior after being reprimanded, shall be punished with at least a warning.
f. Those who read, spread, copy, or trade illegal books or videos, shall be punished with more than a warning according to the severity of the condition.
g. Students who participate in illegal pyramid schemes, or join cults, or take part in questionable superstitious activities will be given a warning, and may possibly receive severe punishment, depending on the circumstances.
h. Students who participate in any form of gambling will be recorded a demerit. Students who actively assemble for gambling purposes will be punished with probation. Students who play mahjong in dormitories, classrooms, or other public places will be issued a warning.
i. Students who engage in activities which exhibit or imply prejudicial attitudes against public morality will be given serious warning and may even receive severe punishment, depending on the circumstances. Students who cause fusses or other social disturbances, or who are discovered of shaking and dropping, will be given a warning and may receive severe punishment, depending on the circumstances. Students who cause serious disturbances during rest time will be given a warning or severe punishment.
j. Students who live outside the college without permission will be issued a warning or more severe punishment according to its hazard rating. Students who allow others live in their dormitories for one day will be given a warning, and for two days or more will be given serious warning or severe punishment. Students allowing others of the opposite sex into their dormitories will be regarded as warranting severe disciplinary action, and both individuals (if the guest is also a student) will be punished accordingly. Misbehavior of students who live outside the college which brings adverse effects to the college will be recorded a demerit according to its identified hazard rating.
k. Students who transport masonry, wood, extra furniture which may affect apartment safety will be given serious warning or more severe punishment according to its identified hazard rating. Students who build access power lines in the apartment or classroom, or use electrical appliances or equipment with open fire will be given serious warning or more severe punishment. Students who make harmful effects will be recorded a demerit and students who make severe effects will be punished with probation. Financial compensation will be charged for economic loss.
17. Students who make serious violations of public morality in male-female relationships will be given serious warning or more severe punishment.
18. Students who store or use flammable, explosive, or toxic materials without permission will be given serious warning or more severe punishment.
19. Students who inappropriately interfere with the communication of others or deliberately divulge others’ secrets will be given serious warning or more severe punishment.
20. Students who insult or slander others, or infringe upon the legitimate rights and interests of others, shall be given serious warning or more severe punishment.
21. Disobeying regulations for the use of the Internet, but in ways that do not constitute criminal behavior, will be punished according to an assigned hazard rating:
a. Students who steal information from or about other people through the Internet will be given serious warning or more severe punishment, depending on the circumstances.
b. Students who maliciously craft, or spread, computer viruses or other destructive programs which cause harmful effects will be given serious warning or more severe punishment, depending on the circumstances.
c. Students will get serious warning or more severe penalties if they use the Internet for making, publishing, or delivering fake information which produces harmful effects on educational order or the reputation of the university. Students will be recorded a demerit or get more severe punishment if they use the Internet for making or delivering information which causes a distortion of fact, or is insulting, indecent, obscene, or violent, or otherwise produces harmful effects.
22. Students who are discovered taking drugs will be recorded a demerit or more severe punishment, depending on the circumstances.
23. Students who are discovered to be engaging in acts of shielding, or inappropriately protecting others, by offering fake evidence or obstructing investigations, will be given serious warning or more severe punishment.
24. Termination for probation is one year. The student’s college is in charge of carrying out regular inspections. If the student is well behaved during this period, his or her probation may be terminated in advance. By the termination of probation, the college shall make the decision to terminate or postpone the probation according to the student’s performance. If the student’s performance is found to be unsatisfactory, but his or her behavior is not enough to warrant further punishment or disciplinary action, then the probation shall be postponed for half a year. If the student has been discovered to have violated college rules during either the initial or extended probationary period, then he or she will be punished with a cancellation of enrollment.
25. If a student is discovered to have committed an offense warranting disciplinary action prior to his or her achieving enrollment status, then his or her qualification for enrollment will be cancelled.
26. Disciplinary actions which are not listed in these regulations shall be handled according to correlative terms. If no reference is found, then it shall be handled according to classes of authority.
27. Authority and procedure of punishment:
a. The student’s college or correlative department shall be responsible for investigating the conditions of misconduct and acquiring evidence.
b. The college is required to check with written material submitted by the student or his or her representative before any decision of penalty is made, and the student is required to submit a written review of the event.
c. Penalties which are less severe than those warranting a record of demerit shall be decided and issued by the student’s college, and shall be reported to the Student Work Office for recording.
d. Academic probation shall be submitted by the student’s college, and be discussed by the Student Work Office and Academic Administration for the decision of penalty, and then the decision shall be submitted to the leadership of the college for both review and the making of an announcement. A penalty of expulsion from academic status shall be discussed by the principle office conference and announced, and shall be submitted for review to the Education Department of Jiangsu Province.
e. Notification shall be sent to the responsible student. In specific situations, it shall be announced at the college, and 7 days from the announcement shall be regarded as submission to the responsible student. The student shall sign the notification for penalties. In case a student refuses or fails to sign, the responsible personnel in his or her college shall submit a written explanation to the Student Work Office for record.
f. Notification of the sanction shall consist of the sanction, facts about the case, and the reason for the sanction. Students shall be informed of any appeals or appeal terminations.
28. Students are allowed to submit any arguments against required penalties to the Student Appeal Committee in written form within 5 workdays from receiving the notification for penalties. The Student Appeal Committee shall carry out a reexamination and inform the student of the result with 15 working days. During the appeal period the penalty shall still be carried out.
29. Any argument against the result of the reexamination by students may be submitted by students in the form of a written appeal to the Education Department of Jiangsu Province within 15 workdays from receiving the notification of reexamination.
30. If a student fails to appeal within the specific time limit from the date of the issuing of the notification for penalties or reexamination, then his or her appeal will not be handled by the college or the provincial education department.
31. Notifications for penalties shall be announced, and shall be reported to the related functional department. The student is allowed to apply for an appraisal before he or she leaves the college, and his or her college is responsible for making the decision on the basis of the student’s performance. Penalties and appraisals will be honestly recorded in the college’s filing system and in the student’s file.
32. Student certificates shall be sent to students who have been expelled. Students shall finish formalities for leaving college within 7 days from the issue of the notification. The student’s file and registered residence will be returned to the seat of his or her household. If the student fails to finish these tasks within the regulated time limit, the specific officer of his or her college shall be responsible for carrying out and recording the unfinished work.
33. Any use of the expression “above terms” of this regulation means “the term and the above terms”, while “less than” does not include the specific item.
34. The Student Work Office is in charge of the interpretation of the regulations stated herein.
35. These regulations are effective from the day revised and issued. In addition to these regulations, students of national defense are required to obey Regulation for Students of National Defense of Nanjing University of Posts and Telecommunications.
According to the decision reached at the Presidents Meeting on May 15th 2014, the management of international students refers to Regulations Regarding Disciplinary Procedures Conducted at Nanjing University of Posts and Telecommunications (2013 Revised Edition). The duties of Student Affairs Department and Graduate Affairs Department are performed by Department of International Cooperation and Exchanges.
